Before Making a Purchase From Albersheim’s

Registration
Create an account on the Albersheim’s web site here. You must have an approved to purchase from our website. If you have previously registered on Albersheim’s LLC, then please use your previously established login and password to login to our website. You only need to register once to purchase from Albersheim’s.
At our sole discretion, Albersheim’s retains the right to revoke any account and any bids previously placed by that account. If you have any problems registering, please contact us. All registration and bidder information shall remain confidential.

Finding Items
Please familiarize yourself with the web site. Go to the homepage where you will find links on the left hand side of the page to guide you in finding the categories of interest to you. You can also search by lot# and keywords in the titles and descriptions using the search box in the top left corner.

Description Errors
Albersheim’s reserves the right to remove an item from our auction at any time. Errors in any listing or lot description, whether typographical, photographic. or technical will be dealt with at our discretion. The website may be updated during the auction to provide additional images or product information.

Autograph Authenticity of Items in Albersheim's Auctions
Every single autographed item that appears in an Albersheim’s (including group lots), is first extensively reviewed by industry autograph expert Richard Albersheim of Albersheim’s LLC.
Regardless of any letters of authenticity that may already accompany an autographed item in an auction,
all items are first reviewed by Richard Albersheim for authentication.

In reviewing each signature for authentication, Albersheim’s LLC uses a multi-level authentication process to provide peace of mind to our clients.  It includes but is not limited to:
A.     Autograph Analysis
B.     Ink/Medium Scrutiny
C.     Object Evaluation
D.     Exemplar Comparisons
E.     Item Provenance
F.     Additional Consultation with Autograph Experts
Following the above authentication process, an autograph is deemed as genuine or not genuine:

Any additional third party LOA that comes with an autographed item in an Albersheim’s LOA and will be listed in the item description.
Should you need further authentication of an autographed item (prior to making a purchase), Albersheim’s encourages interested bidders/clients to utilize the photographs available in the catalogue (web site or printed) and or consult with autograph experts of your choice before making a purchase.

Albersheims 60-Day Return Policy on Autograph Items Only:
Albersheim’s offers a 60-day return policy for authenticity disputes of each item offered at auction. To make an authenticity claim under this policy, the original purchaser of record must abide by the following guidelines:
A.    The refund policy applies solely to the original purchaser of record from the auction or online store and may not be transferred to any third party.
B.     Albersheim’s LLC must be notified within sixty days of the close of the auction or store purchase for an authenticity dispute.
C.     The buyer must provide a written letter of rejection by an independent and recognized expert in the field.  Approved authentication experts include: PSA/DNA, JSA, Beckett, and SGC.  (Please note that any third party authentication fees associated with a rejection letter will not be a part of the refund amount and are the sole responsibility of the original purchaser of the item).  A  rendering  of non-opinion or an "unable to render an opinion" made by a 3rd party authenticator will not qualify as a verifiable opinion one way or another.
D.      The lot must be returned to Albersheim’s in the same condition as it was on the auction end date.
E.       Albersheim’s reserves the right to consult with respected third party authenticators to settle a dispute.
F.       Albersheim’s and its agents will be the sole determinants of the authenticity of each and every piece sold. We are not bound by the opinion of grading services, third-party authenticators, or experts.
G.   The guarantree does not exend to the description of the lot condition due to the subjective nature of such evaluations

At Albersheim’s sole discretion, we may or may not extend a refund, if necessary. Refunds will be issued for the original bid price and buyer’s premium associated only.  NO REFUNDS will be made for shipping charges.

Trading Card Authentication
PLEASE NOTE: All description references to PSA Population Reports, PSA SMR values, and PSA or SGC Set Registry rankings are accurate at the time the catalogue description is composed, and bidders are advised that this information is subject to change at any time.
Grading, condition, authenticity, and warranty of lots: There is a subjectivity to grading - especially the grading of cards. Every effort is made to verify the condition of each lot as described. We do not accept material for auction without careful scrutiny by not only ourselves, but, when necessary, by other leading authenticators. We cannot guarantee that every card described by us will receive exactly the same grade, or even be accepted for grading, by third party grading services.  Similarly, we cannot guarantee that every card graded by one third party grading service will in all cases receive exactly the same grade by another third party grading service. No warranty, whether expressed or implied, is made with respect to any grade, condition, or description, which can and do vary, even among experts.

Albersheim's 60-Day Return Policy - Game Used - Game Worn - Equipment
All items deemed as “game used” or “game worn” are extensively researched.  When a piece is not directly sourced from the player or player’s family, we do our due diligence to try and determine wear and/or usage of an item that would represent usage attributed to the particular athlete.  We do our best to research and find photo matches to the particular item or style.
All items that fall under this category will come with a Letter of Authenticity from Albersheim’s LLC.  If there’s a player letter or a letter of provenance, this will be included with the lot along with any documentation from 3rd party authenticators. This will be mentioned in our printed catalogue or online catalogue.
Our policy for game used/worn equipment is the same standard policy as our autograph authenticity policy.
Approved authenticators include: MEARS (jerseys), John Taube (bats), and Dennis Eskin (gloves).

After Reserving and Item/Lot and Making a Purchase

Payment
Accepted forms of payment are check, money order, and wire transfer, and  Paypal.  All payments must clear prior to items being shipped.  Property will not be released to you, your agent, or a shipper for up to seven business days after payment in order to allow payment to clear.

For Wire Transfers: please include your account name and lot numbers purchased as the “additional information” that you may provide when sending the wire transfer.  If paying by wire transfer, there will be an additional fee of $20 per our banking fees.
Any returned checks will incur a $50 bank fee and payment must then be made by money order or bank check.

Shipping
Please allow up to 7 - 10 business days for items to be processed for shipping AFTER payments have cleared.
-The majority of items will be shipped USPS priority mail
-All shipments will be insured
-All shipments over $200 require signature confirmation
-All shipments with a value over $5,000 will be sent via Fed EX with signature confirmation
-Large/Bulky shipments may be sent via FedEx with signature confirmation
Contact us if you'd like to use an alternative shipping method.  Prior to bidding, please be aware of estimated shipping costs, especially for large or heavy lots.  Shipping out of the U.S. will cost substantially more.  You may contact Albersheim’s LLC for shipping estimates of any lot. Packages shipped internationally will have full-value declared on all shipping forms.  The Buyer is responsible for all duties and customs charges.

Sales Tax
Shipments made within the State of California will be charged a 7.75% sales tax unless the bidder has provided to Albersheim’s with a current and valid California tax exempt resale certificate.

Additional Terms and Conditions

As Is
All property is sold “as is” without any representations or warranties by Albersheim’s or the Consignor as to the merchantability, fitness for a particular purpose, the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature, or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation, or assumption of liability.  Albersheim’s and the Consignor make no representations or warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property.  The purchase of any letter or document does not give the buyer any copyright ownership.  Albersheim’s and the Consignor are not responsible for errors and omissions in the printed catalogue, on-line catalogue, or any supplemental material or in regards to the failure of the auction program to execute any bids on behalf of the bidder.
All descriptions, photographs, illustrations, and terminology including but not limited to words describing condition (including any condition reports requested by Buyer), authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition, and relevance, used in the catalog, bill of sale, invoice, or anywhere else, represent a good faith effort made by Albersheim’s to fairly represent the lots and property offered for sale as to origin, date, condition, and other information contained therein; they are statements of opinion only. They are not representations or warranties and Buyer agrees and acknowledges that he or she shall not rely on them in determining whether or not to bid or for what price. Price estimates (which are determined well in advance of the auction and are therefore subject to revision) and condition reports are provided solely as a convenience to Buyers and are not intended nor shall they be relied on by the buyer as statements, representations or warranties of actual value or predictions of final bid prices.

Trademarks, Copyrights, & Restrictions
All materials on this site, including, but not limited to, images, illustrations (the "Materials") are protected by copyrights which are owned or licensed by Albersheim's. You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any Materials from Albersheim's or any other web site owned or operated by Albersheim's without the prior written permission of Albersheim's. However, you may download or make one copy of the Materials, and other downloadable items displayed on the site, for personal non-commercial home use only, provided all copyright and other notices contained in the Materials are left intact. Any modification of the Materials, or any portion thereof, or use of the Materials for any other purpose constitutes an infringement of the Albersheim's copyrights and other proprietary rights. Use of these Materials on any other web site or other networked computer environment is prohibited without prior written permission from the Albersheim's. 

Additional Terms
The title to each lot/item will remain with Albersheim’s LLC or the Consignor until payment has cleared.  Albersheim’s LLC retains the right to withdraw any item in the sale prior to the closing date of the sale for any reason whatsoever and shall have no liability for such withdrawal.  Any necessary corrections to the printed catalogue shall be published in the Addenda on-line.  All capitalized heading and lot description references to PSA – SGC population reports, SMR values, and PSA set registry rankings are as of the time that this auction was produced.  We reserve the right to reject a bid from any bidder. The highest bidder acknowledged by us shall be the purchaser. In the event of any dispute between bidders, or in the event we doubt the validity of any bid, we shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article. If any dispute arises after the sale, our sales records shall be conclusive in all respects. If we are prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages.

The buyer expressly authorizes Albersheim’s to rescind the sale of any lot for any reason, including but not limited to, if it is learned that the lot may not be authentic, or may be a forgery or counterfeit; the item is damaged and/or there is outside dispute with title/ownership of the said item/lot. Upon notification of rescission the bidder agrees to indemnify Albersheim’s L in all legal capacities.

By making a purchase from Albersheim’s, the buyer consents to the application of the laws of the state of California without application of conflicts of laws and the jurisdiction of the state of California in the county of Orange.  In no event, shall Albersheim’s liability to a purchaser exceed the purchase price of record for the lot.

These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by Nevada law. By bidding in an auction, whether by Web, Fax, Mail, Telephone or other means, the buyer or bidder agrees to be bound by these Conditions of Sale. Any dispute, controversy or claim arising out of or relating to the Agreement or the breach, termination or validity thereof, brought by or against Albersheim's. (but not including claims brought against the consignor by the purchaser of lots consigned hereunder) shall be resolved by Arbitrator.

The Arbitrator shall be empowered to order specific performance and to award consequential damages and pre-award interest, but shall not be empowered to award punitive damages. The arbitration shall be governed by the U.S. Arbitration Act, 9 U.S.C. 1-16, and judgment upon the award rendered by the Arbitrator may be entered by any court having jurisdiction thereof. Each party shall bear its own attorney’s fees and expenses in connection with such proceedings and shall bear one-half of the Arbitrator’s fees and expenses.
